Please read carefully: by hiring our services, you (herein referred to as “Client”) agrees to the follow terms stated herein.
General
This website (the “Site”) is owned and operated by FBA Creatives (“FBA Creatives,” “we,” or “us”). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from FBA Creatives. Accessing the Site in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.
In addition, when you use any of our current or future services, you will also be subject to our guidelines, terms, conditions and agreements applicable to those services. If these Terms of Use are inconsistent with the guidelines, terms and agreements applicable to those services, these Terms of Use will control.
We reserve the right to change these Terms of Service or to impose new conditions on the use of the Site from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after any such changes, you accept the Terms of Service as modified.
Not Satisfied Refund Policy Terms
We strive to ensure that every Client is fully satisfied with our services. However, if you wish to request a refund, please note the following conditions. All of these conditions must be met for a refund to be considered:
No Additional Information
You must not have introduced or submitted any new product information after filling in your initial design brief. Any changes or new details added to the brief render it ineligible for a refund request.
“New product information” refers strictly to factual or structural changes to the product or packaging, including but not limited to: New or updated product photos; New manufacturer photos; New dielines or structural packaging files; Changes to the physical product, ingredients, formulation, components, or included items; Changes to required legal, regulatory, or compliance text; New multilingual text not included in the original brief; New feature sets, claims, instructions, or functional benefits; New versions or variations of the product; New brand guidelines that redefine the brand identity; New information that alters the factual content of the deliverables.
If any of the above items are submitted after the initial brief, the project becomes ineligible for a refund under this policy.
FBA Creatives may request missing assets (for example: real product photos, translations, or manufacturer information) in order to complete the work. Such requests do not waive or modify this rule. If you choose to provide additional materials after the brief, this still counts as “new product information” and disqualifies the project from refund eligibility.
The following items do NOT affect refund eligibility:
Stylistic preferences
Visual references
Colour palette changes
Layout adjustments
Font preferences
Design direction changes
Creative suggestions
Mood board refinements
Requests to explore alternative aesthetics
These are considered part of the normal revision process.
Timing of Refund Request
You must submit your refund request before receiving the final deliverables associated with your purchase. “Final deliverables” are the watermark-free, production-ready files.
Any request made after confirming your designs and receiving the final watermark-free downloadables will not be eligible for a refund.
20-Day Window
A refund request can only be made within 20 days from the date you hired FBA Creatives’ services (date of purchase). If more than 20 days have passed since purchase, you are no longer eligible for a refund.
Submitting new information, requesting revisions, or experiencing communication delays does not pause, reset, or extend this 20-day window. Internal response times and email delays do not extend or modify this 20-day period.
How to Request a Refund
To initiate a refund, please send an email to contact@fbacreatives.com. Include your order number, the date you hired our services and submitted your design brief, and any relevant correspondence. We will review your request and respond within a reasonable timeframe.
By adhering to these guidelines, you help us maintain a fair and transparent process for all clients. If you have any questions or concerns, feel free to contact us at any time.
Performance Guarantee Terms
Our Performance Guarantee applies exclusively to the Full Kickstarter Launch Strategy Package. If your Kickstarter campaign does not raise at least the amount paid for this package ($4,999), we will refund the difference between your campaign’s total funds raised and the package cost.
To be eligible for this guarantee:
You must fully implement the assets, strategy, and recommendations provided by our team without alterations.
The campaign must go live within 60 days of final delivery of the full asset package.
You must notify us in writing within 20 days after your campaign ends to claim the refund.
Refunds are based on the total funds raised, as reported on your public Kickstarter page, excluding canceled pledges or failed payments.
This guarantee is only valid for campaigns launched on Kickstarter.com and does not apply to other platforms or crowdfunding methods.
This guarantee reflects our commitment to your campaign’s success, but results may vary depending on external factors beyond our control, including product-market fit, audience size, and pricing decisions.
Unlimited Revision Policy Terms
We are committed to ensuring you are fully satisfied with your design drafts. As part of this commitment, we offer unlimited revisions under the following conditions:
No New Submissions
Unlimited revisions apply only to the product information submitted in your initial design brief. To remain eligible for unlimited revisions within the same project scope, you must not introduce new product information after submitting the brief.
You may not add new factual details about the product, packaging structure, compliance text, or other information that changes the substance of the project after the brief has been completed. If new product information is provided after the brief, this will be treated as a change of scope and may require a separate service or additional fee.
What Is Allowed: Stylistic feedback is always allowed and does not violate this policy. You may request unlimited creative adjustments such as changes in layout, style, colours, fonts, mood, or general artistic direction.
3 Business Day Feedback Window
To qualify for a revision, you must submit your revision requests or feedback within 3 business days of receiving each design draft. Requests submitted after this period may not be eligible for additional revisions under this policy.
Finalization of Project After No Response
If no feedback or revision request is received within 3 business days of delivery of the first draft, FBAcreatives.com will assume that no revisions are needed. In this case, we reserve the right to finalize the project and deliver the final files based on the most recent draft.

7-Business Days Delivery Guarantee
FBA Creatives maintains a 7-business-day guarantee for the delivery of the first draft. This guarantee ensures timely project initiation while maintaining fairness and accuracy.
The 7-business-day period begins only after all essential product materials have been received, including product photos, dielines, required text, translations, compliance information, and any factual product details needed to start design work.If any essential assets are missing from the initial brief, the countdown begins on the date those missing materials are provided.
Minor delivery variations (1–3 business days) may occur due to complexity or workload and are not considered a breach of the guarantee. This guarantee does not override or modify the Not Satisfied Refund Policy. A slight delay in draft delivery does not qualify a project for a refund unless all refund conditions are independently satisfied.
Our Limited License to You
This Site and all the materials available on the Site are the property of FBA Creatives and/or our affiliates or licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal and commercial use in connection with evaluating or purchasing our design services. You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us.
Unless explicitly authorized in these Terms of Service or by us, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute any material from the Site in any manner or medium (including by email or other electronic means). You may, however, download and/or print individual pages of the Site for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.
Copyright of All Assets
Your License to Us
By submitting any material (including, but not limited to, images, logos, design requests, feedback, testimonials, or any other content) to us via the Site, social media, or email, you represent that: (i) You own the material or have obtained all necessary rights and permissions to submit it; (ii) The material does not infringe on any third-party rights; and (iii) You are at least eighteen years old or have parental consent.
By submitting content, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, adapt, publish, distribute, and display the material for marketing, promotional, and service-related purposes. We will not use client-provided materials in a way that misrepresents your brand or business.
You Own Your Designs
For any original designs, graphics, or other creative work produced by FBA Creatives for you, ownership is transferred to you upon service completion. Once we finalize a project and deliver the final files to you, all rights, including copyright ownership of the delivered assets, are transferred to you. You will hold exclusive ownership and control over the intellectual property rights of the final assets. However, we reserve the right to use completed work for promotional purposes unless otherwise agreed upon in writing.
You acknowledge that Fbacreatives.com has the right but not the obligation to use and display any postings or contributions of any kind and that Fbacreatives.com may elect to cease the use and display of any such materials (or any portion thereof), at any time for any reason whatsoever.
Limitations on Linking and Framing: You may establish a hypertext link to the Site so long as the link does not state or imply any sponsorship of your site by us or by the Site. However, you may not, without our prior written permission, frame or inline link any of the content of the Site, or incorporate into another website or other service any of our material, content or intellectual property.
Chargebacks Constitute Breach
Initiating a chargeback for services delivered or in progress is a breach of agreement. FBA Creatives maintains documentation of draft delivery, revisions, Client communication, delays, and asset submission dates. If a chargeback is initiated, all work stops immediately, and no intellectual property transfers until resolution.
Service
FBA Creatives provides graphic design services tailored to eCommerce sellers, including but not limited to 3D renders, listing images, A+ Content, and branding consultations.
Fbacreatives.com, and all affiliated companies currently provides users with personalized content (collectively referred to as the “Services”). You also understand and agree that the Service may include sponsorships or advertisements.
Any and all Fbacreatives.com, services shall be subject to the Terms of Use. You understand and agree that any and all Service is provided “AS-IS” and that Fbacreatives.com, assumes no responsibility for the timeliness, deletion, delivery problems or failure to store any user communications or personalization settings.
- You are responsible for providing accurate details for design requests, including product specifications, brand guidelines, and necessary assets. All details should be provided on the design brief upon payment.
- The FBA Creatives Not Satisfied Refund Policy and the Unlimited Revision Policy stated on the Terms of Service apply to all services provided in Fbacreatives.com.
- Turnaround times vary depending on project complexity and workload; estimated delivery times are provided but not guaranteed.
- We retain the right to refuse service for any project that violates Amazon’s terms, promotes illegal activity, or includes offensive content.
Payments and Fees
You will be charged for any materials that you wish to purchase from us. Prices may vary. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display of delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.
- Prices for services are listed on the Site or provided upon request. We reserve the right to change pricing at any time.
- Payment is required before work begins unless otherwise agreed upon.
- Additional fees may apply for rush orders, major revisions, or project scope expansions.
- If a chargeback or payment dispute is initiated, we reserve the right to suspend ongoing projects and take appropriate legal action.
Consultation Call Clause
The included consultation call is optional and must be requested by the Client. If the Client does not request the call, this is not considered a missing service or grounds for a refund.
Disclaimers
Throughout the Site, we may provide links and pointers to internet sites maintained by third parties. Our linking to such third-party sites does not imply an endorsement of those sites, nor are we responsible for the content, products, or services offered by third parties.
The information, products, and services offered on or through the Site are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
We do not warrant that the Site or any of its functions will be uninterrupted or error-free, that defects will be corrected, or that any part of this Site is free of viruses or other harmful components.
In no event shall FBA Creatives, its affiliates, or their respective officers, directors, employees, agents, successors, or assigns be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Site or our services, including but not limited to loss of profits, goodwill, data, or other intangible losses, even if advised of the possibility of such damages.

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which FBA Creatives operates, without regard to conflicts of law principles.
